Official Rules

 

THE TERMS AND CONDITIONS REGARDING THE NOMINATION AND ANY OTHER COMPONENT OF THE VERIDIAN CREDIT UNION (“VERIDIAN”) “VERIDIAN GIVES BACK FOR GIVING TUESDAY CAMPAIGN” (“CAMPAIGN”) ARE SUBJECT TO CHANGE AT ANY TIME AT THE SOLE DISCRETION OF VERIDIAN. NO PURCHASE NECESSARY TO NOMINATE OR WIN. A PURCHASE WILL NOT INCREASE THE NOMINEE’S CHANCES OF WINNING. MEMBERSHIP AT VERIDIAN CREDIT UNION IS NOT NECESSARY TO NOMINATE AND WILL NOT INCREASE THE NOMINEE’S CHANCES OF WINNING. VOID OUTSIDE OF IOWA, MINNESOTA, NEBRASKA AND WHERE PROHIBITED BY LAW. BY PARTICIPATING, NOMINATORS AND NOMINEES AGREE TO THESE OFFICIAL RULES AND THE DECISIONS OF VERIDIAN, WHICH ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE CAMPAIGN.

 

  1. Eligibility to Nominate. The Nominator must be a legal resident of Iowa and Minnesota who is 18 years of age or older at the time of nomination and legal residents of Nebraska who are 19 years of age or older at the time of nomination. No purchase, payment, or donation of any kind is required to participate and will not increase the likelihood of your nomination being selected. Your nomination in connection with or any other participation with this Campaign constitutes your full and unconditional acceptance of these terms and conditions.
  2. Eligibility to be a Nominee. Nominee must adhere to Veridians’ funding eligibility guidelines which make adult and youth recreational/club sports teams, purposes that benefit an individual or a small group, political organizations or candidates or religious programming ineligible for funding. Nominee must also fall under one of the following funding priorities of affordable housing, basic human needs, diversity, equity, and inclusion, employment readiness, or financial literacy. Nominee must be a 501(c)(3). Nominee must provide services in one of Veridian’s branch markets and must not conflict with Veridian’s core values or engage in illegal activities. Nominee is ineligible for a donation from this Campaign for 2 years after previously winning a donation from this Campaign. No purchase, payment, or donation of any kind is required to participate and will not increase the likelihood of the Nominee being selected. The Nominee in connection with or any other participation with this Campaign constitutes your full and unconditional acceptance of these terms and conditions. Void where prohibited by law.
  3. Nomination Period. Nominations will commence on Wednesday, November 1, 2023, at 10:00 a.m. and end on Sunday, November 12, 2023, at 11:59 p.m. CDT. The nomination period is subject to change without prior written consent and at the sole discretion of Veridian.
  4. How to Nominate. A Nominator may nominate by visiting www.veridiancu.org/GivingTuesday during the nomination period and completing the supplied registration form in its entirety. The Nominator is required to provide (a) first and last name, (b) current valid email address, (c) name of nonprofit organization, (d) phone number of nonprofit, (e) category of nonprofit organization, and (f) nearest Veridian branch community. The Nominator will follow the on-screen instructions to submit one nomination for the organization of their choice. Limit of one nomination per Nominator, per Campaign.
  5. Alternate Method of Nomination. A Nominators may also nominate by printing the words “Veridian Gives Back for Giving Tuesday Campaign” and (a) first and last name, (b) current mailing address, (c) name of nonprofit organization, (d) phone number of nonprofit, (e) category of nonprofit organization, (f) nearest Veridian branch community, and (g) date on a 3x5 card or postcard and mailing it (1 per envelope) to: Veridian Credit Union, Attn: Marketing, 810 N 96th Street, Suite 203, Omaha, NE 68114. Mail-in entries must be received by Sunday, November 12, 2023.
  6. Disclaimer. Veridian assumes no responsibility for nominations it is unable to process due to network, hardware, or other technical failures; or any other reason, including but not limited to incomplete, damaged, misdirected, or lost nominations by mail or otherwise. If, for any reason, the fairness or integrity of the Campaign becomes compromised, Veridian reserves the right to terminate or modify the Campaign, and to disqualify any Nominee or Nominator who tampers with the nomination process or the administration of the Campaign.
  7. Determining the Winner. A random drawing will be held on or before Monday, November 13, 2023, to select six winners. Drawing date is subject to change without notice. Each winning Nominee will receive one donation. The odds of winning the donation depend on the total number of eligible entries. Limit of one entry per Nominee. Limit of one donation per Nominee. Veridian’s selection shall be final and binding.
  8. Winner Notification. Each willing Nominee will be notified by email and/or phone within one business day of the applicable drawing date. Failure to respond to notification within 72 hours, an inability of Veridian to reach the potential winner or a return of any donation or donation notification as undeliverable may result in forfeiture of the donation. Unclaimed donations may be reallocated at Veridian’s discretion.
  9. Donation. Each winning Nominee will receive one donation. The donations include five $5,000 and one $10,000 donation. The total amount that Veridian will donate over the course of the Campaign is $35,000. The amount or value of a donation may be subject to taxes, fees, or other charges. Each Nominee receiving a donation is solely responsible for any taxes, fees, or other charges, and is advised to seek the services of a tax specialist regarding the tax implications.
  10. Participant Obligations. Each Nominator that nominates an organization, Nominee that accepts to participate or otherwise participates in the Campaign agrees to defend, indemnify, release, and hold harmless Veridian from and against any and all losses, demands, damages, rights, claims, injuries, actions, and liabilities of any kind arising out of or related to such person’s or entity’s nomination or participation in the Campaign. Any disputes that may arise hereunder shall be governed in all respects by the laws of the State of Iowa without regard to the conflicts of laws principles of any jurisdiction. Venue with respect to any such disputes shall be had in the state and federal courts of the State of Iowa. Veridian’s failure to enforce any term of these rules shall not constitute a waiver of that provision. Any Nominator that nominates an organization, Nominee that accepts to participate or otherwise participates in the Campaign, agrees to waive the right to claim any additional damages whatsoever, including, but not limited to, punitive, consequential, incidental, or indirect damages.
  11. Release. Each Nominator and Nominee authorize Veridian to use their name, voice, and likeness in promotional material and for advertising, public relations, editorial, and all other permissible purposes worldwide, in any media, in perpetuity, or on a winner’s list without further compensation unless prohibited by law.
  12. General Rules. By nominating, accepting the nomination or otherwise participating in the Campaign, participants agree to be bound by these terms and conditions and by the decisions of Veridian, which are final and binding in all respects. Veridian is not responsible for: (1) any incorrect or inaccurate information or technical failures of any kind, (2) unauthorized human intervention in any part of the nomination process; or (3) any other computer, network, technical, human or other error, problem, or malfunction that may occur in connection with the administration of the Campaign, the processing of nomination, or otherwise. Veridian also reserves the right at its sole discretion to disqualify the nominations of any Nominator or entity found to be (a) tampering or attempting to tamper with any part of the process; (b) using any robotic, macro, automatic, programmed, or like entry methods, which will void all such entries; or (c) violating these terms and conditions. Veridian makes no warranties, and hereby disclaims any and all warranties, express or implied.
  13. Personal Information. Any personal information collected through this Campaign is subject to Veridian’s privacy policy, located at https://www.veridiancu.org/privacy. By nominating, accepting the nomination or otherwise participating in the Campaign in any way, and to the extent permitted by applicable law, you agree to the use of your personal information as described in the above Privacy Policy.
  14. Dispute Resolution. Except where prohibited, by participating in the Campaign, Nominator and Nominee agree that all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of participant(s) and Veridian and its agents shall be governed by and construed exclusively in accordance with the laws of the State of Iowa without giving effect to any principles of conflicts of law of any jurisdiction. Nominator and Nominee agrees that any action at law or in equity arising out of or relating to this contest, or awarding of the donations shall be filed only in the state or federal courts located in the State of Iowa and entrant hereby consents and submits to the personal jurisdiction of such courts for the purposes of litigating any such action. Except where prohibited, by participating in this contest, entrant agrees that: (a) any and all disputes, claims and causes of action arising out of or connected with this contest, or awarding of the donation, shall be resolved individually, without resort to any form of class action; and (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with participating in this contest but in no event attorneys' fees; and (c) under no circumstances will any participant be permitted to obtain awards for and hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
